How to Claim Compensation

Injuries litigation in the U.K. can be an expensive process for the person or persons who have been the victim of an accident that was due to someone else's negligence and that injures them.

A professional injury litigator can make the difference between whether or not the injured party is successful in getting full compensation for the injuring that they have suffered. They have the skills and experience that can take the personals of an accident claim and use them to personalise and tailor a damages claim that will maximise the potential award for the case being litigated.

Even though a claimant may recognise that they need the services of a solicitor when starting to litigate, paying for the litigator may be a concern for someone who is already struggling with medical costs, lost wages and other expenses resulting from their case. They might be reluctant to take formal action if they feel that doing so may further injure their financial situation. However, in the United Kingdom there are other options for advice and other possible sources of assistance that often reduce or pay for the costs associated with personal litigating.

Solicitors are not the only source of advice on issues in Great Britain. Help is also available for free from other legal professionals at organisations such as the Citizens Advice Bureaux, Community Legal Services Direct or local area Law Centres. These offices can be found throughout Great Britain. They can provide a potential claimant with an opinion as to whether or not the person has a valid case and they are a fountain for information on the steps necessary for filing different types of injury claims. But they cannot provide representation should the case go to court. A claimant can choose a friend or representative to represent them, or can even represent themselves. However, should a case reach the litigation stage and the claimant wants to contract the services of a solicitor, then these agencies can make recommendations as to reputable solicitors or law firms in the claimant's area.

These government agencies can also help you to determine if you qualify for aid through the legal help scheme. A person can qualify for this assistance if they have a low enough income and if they don't have a significant amount of savings. More information on legal aid programs is available from the Community Legal Service Direct office, but the service normally provides for free legal advice on legal problems, assisting in negotiation or writing letters, getting a barrister's opinion on a case or assistance with preparing the case for tribunal.

If you make an appointment with a solicitor before you have checked with one of these agencies to see if you qualify for assistance, don't worry. It is the law that at a first meeting with a solicitor, he or she must have a conversation with you about the potential costs involved in the case, how you intend to meet those costs, and they must also assess whether or not you are eligible for publicly funded legal resources.
